Release of liability, waiver of claim, and indemnity agreement

The undersigned accepts full responsibility for the rental equipment and agrees

to pay for any damage to the equipment or replace equipment at full cost value if damaged or stolen
Bikes or rental equipment returned with excessive dirt, mud, oil and debris will be assessed a $25 cleaning fee
I and all others in my party know how to ride bikes and am familiar with the proper use of the bicycle equipment, including quick release mechanics as well as brakes and gear shifters. I am aware that Ben’s Bikes mechanics and staff are available to answer cycling equipment use questions. I am aware that quick release mechanisms, brakes and other parts of the equipment will not function as optimally intended at all times and may be affected by weather conditions, moisture, terrain and path conditions.
I am aware that the rental equipment is not to be used off road, off path or in water.
I am aware that cycling includes risks and hazards from route conditions, vehicles, pets, failure to know one’s limitations in terms of speed, turning, gravity and negligence of other cyclists.
Employees and owners of Ben’s Bikes Sequim inc. as well as the manufacturers of the rented equipment cannot guarantee my safety or freedom from injury while cycling given that it is not possible to predict every circumstance or condition under which the equipment will not operate as intended
I freely accept such risks, dangers and hazards and the responsibility for personal injury, death, property damage and loss resulting therefrom. I hereby agree to waive any and all claims against Ben’s Bikes Sequim inc, its’ members, employees, owners and vendors; to hold harmless and indemnify Ben’s Bikes Sequim inc., its’ members, employees owners and vendors; to bind this agreement on my heirs, next of kin and representatives in the event of my death or incapacity; to be governed by the laws of the state of Washington, and; to agree that any litigation arising from this agreement shall be within the exclusive jurisdiction of the courts of the state of Washington.
I have read and understand this agreement and sign it freely, voluntarily, and with knowledge of its contents. I am aware that by signing this agreement, I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators and/or representatives may claim against Ben’s Bikes Sequim inc.
